1. Subject
The following general terms and conditions of sale govern the distance sale of admission tickets for national and international events of entertainment and/or cultural entertainment through the website www.ticket.it.
The sale is carried out by MTicket S.r.l. in the name and on behalf of third-party companies and/or on its own behalf.
2. Liability
The selection of Events for which the Operator allows the Purchase is at the total and unquestionable discretion of the Operator itself.
The Operator receives the information regarding the Events and proposes it to the User on the Website as it is provided by the Event Organizers and cannot under any circumstances be held liable for any inaccuracies contained therein.
The Website offers Users accessing the website www.ticket.it:
- advance sale of admission tickets;
- provision of services connected thereto necessary and ancillary to the advance sale;
- possible sale of merchandise related to the aforementioned shows, entertainment and events.
The User who makes use of such Services is required to comply with all the General Conditions set out therein, which must therefore be read and approved before completing the purchase operation.
These conditions may be modified at any time. Any changes shall be effective from their publication on www.ticket.it in the "Terms and Conditions" section, present in the footer of each page of the website. Users are therefore invited to regularly access the Website and to consult, before making any purchase, the most updated version of the General Conditions. Each purchase shall be governed by the General Conditions in force at the time of the same.
3. Definitions
The following definitions apply to these General Conditions of contract, it being understood that definitions in the plural shall apply to the corresponding term in the singular and vice versa:
- Sales platform: MTICKET ver. 1.8 owned by MMM Holding S.r.l. deemed suitable by the Italian Revenue Agency, in its hardware and software components, for the issuance of admission tickets, with provision no. 2024/224367 of May 9, 2024;
- Owner of the sales platform: MTicket S.r.l. with registered office in Via Ettore Romagnoli 6, 20146 Milan – Italy, is the entity entrusted by the event organizer with the sale of admission tickets through the website ticket.it (hereinafter Website);
- Event: indicates the event, show or performance to which the holder of the admission ticket may gain access;
- Event Venue: indicates the set of buildings and lands that constitute the locations where a specific Event takes place;
- User: is the person who purchases from the Organizer the admission tickets to the Event electronically;
- Holder of the admission ticket: is the person who legitimately holds, in compliance with these General Conditions of Contract, an admission ticket purchased by the User;
- Admission ticket: is the document issued by the Organizer through the sales platform that entitles the holder to access the Event Venue;
- Contract: is the agreement between the User and MTicket S.r.l. and the event organizers that regulates the purchase process of admission tickets.
4. Online purchase procedure
The User, in order to complete a Purchase, shall, in order:
- choose the event of interest;
- choose and/or confirm the requested date and time of participation in the event;
- choose, if provided, the type of seat;
- choose the price type based on the indications provided by the organizer (entitled to reductions);
- insert the selected tickets into the Purchase cart;
- possibly proceed with another or other purchases;
- choose, if provided, the method of delivery or shipment of the tickets;
- check the summary of the Purchase data;
- correctly enter all the data required for identification, payment and possible shipment;
- proceed with the final confirmation of the transaction.
It is reminded that from the moment the tickets are placed in the cart the User has 20 minutes to complete the Purchase with payment confirmation, once the time has expired, the tickets will be removed from the cart and will return to public sale.
To complete the purchase it will be sufficient to enter one's data during checkout, or alternatively, if the type of event being purchased requires it, the user shall be required to register on the website.
In detail, as provided by the amendment to the Budget Law (No. 145 of December 30, 2018), for events with a capacity greater than 1000 seats the user purchasing tickets online must be identified. The regulation applies exclusively to certain categories of events, such as, by way of example and not limited to, pop music concerts.
5. Registration on the Website
Registration on the Website is free of charge. In order to register on the Website and create the relevant account, the user must complete the appropriate form, entering their personal data as requested therein, as well as an email address and a password.
It is absolutely and strictly forbidden for the user to enter, for the purpose of registration on the Website, false, invented, fictitious, incomplete or otherwise inaccurate identification data and/or in any way not corresponding to the truth or referring to third parties. It is also forbidden for the user to create on the Website multiple accounts referable to the same person, whether natural and/or legal, and/or to companies and/or entities of any kind, even through the use of data corresponding to the truth.
Registration on the Website allows the user to carry out, through their reserved and personal account, among others, the following activities:
- make purchases on the website;
- check the status of the most recent orders and view the archive of all orders placed;
- manage their personal data and modify them at any time;
- change their password.
During registration on the Website the user may choose to validate their telephone number by means of the One Time Password (OTP) validation code sent via SMS. The validation of the telephone number is provided for by Law No. 145 of December 20, 2018, amending art. 1, paragraph 545 et seq. of Law 232/2016 (Budget Law 2017), which requires that the user purchasing admission tickets through online channels on official ticketing websites be identified through OTP validation. Where the user chooses not to carry out telephone number validation during registration on the Website, they shall carry it out during the procedure of the first purchase order.
The registration credentials (email address and password) must be kept with the utmost care and attention and may be used exclusively by the user. The user undertakes to keep them secret and to ensure that no third party has access to them.
6. Ticket prices
- Ticket value: it is set by the Organizer and includes two components, namely the cost of the ticket to attend the event and any presale fees. The presale fee is a consideration attributable for tax purposes and due to the Organizer itself, as established, regulated and clarified by the Ministry of Finance.
The Organizer reserves the right to modify the Price of the Admission Tickets at any time, it being understood that in the case of purchase through the Website the price charged to the user shall be that indicated on the Website and in the Order Summary and that any subsequent variations (whether increases or decreases) after the transmission of the order shall not be taken into account;
- Agency fees: this is a fee established by the reseller, as remuneration for the services rendered, due and attributable for tax purposes to the reseller itself. The agency fee shall never be refundable even in the event of cancellation of the event;
- Additional costs: in some cases, depending on the choices made by the user, additional costs may be added to the order such as, by way of example and not limited to, ticket shipping, any insurance coverage, etc.;
- Total amount: sum of the value of all admission tickets plus any agency fees and additional costs. All prices indicated are expressed in Euro and shall be considered inclusive of VAT;
- IMPORTANT | The ticket value, presale fee, agency fees and any additional costs are separately indicated during all stages of the purchase, in the order summary and in the order confirmation email.
7. Payment methods
The payment methods for the purchase of Admission Tickets are those from time to time displayed and made available on the Website. MTicket uses secure payment services through the following payment gateways: Nexi, Satispay, Carta del Docente and Bonus Carte Cultura.
Payments will be handled through secure connections and the data necessary for transactions will be transmitted directly to the payment provider without passing through the servers used by MTicket, therefore the Operator is not able to access any sensitive data relating to the transaction, nor is it able to intervene in the event of a transaction being denied for any reason.
In any case of refund, for any reason whatsoever, the refund amount shall be credited to the same payment method used by the Customer for the initial transaction; where this is not possible, the refund shall be made by bank transfer, in which case MTicket shall request from the user the bank details necessary to carry out the refund.
8. Purchase with Culture Bonus Cards and Teacher Card
The purchase through Culture Bonus Cards and Teacher Card is strictly and exclusively reserved to the holder of the Culture Bonus Card and of the Teacher Card.
The person making the purchase implicitly declares to be the aforementioned holder as well as the user of the purchased product. The holder of the Culture Bonus Card and Teacher Card may not transfer the purchased product to third parties.
The holder of the Culture Bonus Card and Teacher Card may also purchase only one unit of each product.
For the purchase it is necessary to generate a voucher of an economic value equal to the product to be purchased. The value of the voucher must include, in addition to the cost of the ticket/subscription, also any agency fee applied.
Once the purchase has been successfully completed, it is not possible to cancel or modify the transaction in any of its parts (waivers, requests for partial or total refunds, cancellations, changes of dates and times of visit and access, changes of seat type and price type) for any valid reason whatsoever, by the purchaser, since, pursuant to Article 55, paragraph 1 letter b), of Legislative Decree October 6, 2005 No. 206 ("Consumer Code"), the right of withdrawal referred to in Articles 64 et seq. of the same Consumer Code does not apply to purchased tickets.
Therefore, in the event of waiver, even for any justified and serious reason and/or impediment, by the Purchaser to access/participate in the Event, no refund, even partial, is provided by the Operator, neither for the price relating to the cost of the event, nor for presale fees, agency fees and any shipping costs, as well as other costs incurred by the Purchaser on their own account. In the event of cancellation of the event, refunds in cash are prohibited and the validated voucher can no longer be cancelled and credited back. MTicket.it will provide, in agreement with the Purchaser, a product of equivalent economic value among those available.
9. Ticket delivery and access to the event
The delivery of Admission Tickets purchased on the Website may take place in the following ways:
- tickets in PDF format sent as an attachment to the purchase confirmation email;
- collection at the event venue or designated location.
Both PDF tickets and purchase confirmation may be presented in digital or paper format.
All users must be in possession of a valid Admission Ticket to access the event. The Admission Ticket constitutes a valid access title exclusively for the Event for which it was issued, on the date and at the time indicated therein.
The Organizer has the right to refuse access to the Event Venue in case of irregularity of the Admission Ticket or Purchase Confirmation or in the event that either is lost, stolen, destroyed, damaged, deteriorated or even only partially illegible as presented by the Customer not perfectly intact; the Organizer also has the right to carry out checks on the person for security reasons.
10. Postponed or cancelled event
In the event of cancellation, postponement or change of an Event for which the User has made a Purchase, the rules and procedures adopted from time to time, in accordance with the law, by the Organizer, sole party responsible for the Event, shall apply.
The Operator shall in turn communicate to the User via email as soon as possible all changes and information provided by the Organizer.
In the event of cancellation of the Event, MTicket shall proceed with the refund to the user, according to the methods and timing decided by the Organizer. The user is reminded that the Organizer, in case of cancellation of the Event, reserves the right to retain the presale fee and that, also in this case, the Operator is completely unrelated to the Organizer's decisions.
Where partial and/or total refunds of tickets or replacements with other tickets are provided, MTicket shall behave like any other presale agency, refunding the value of the tickets or part thereof (as determined by the Organizer), net of agency fees and payment commissions.
In the event of non-performance of the Event, the refund established by the Organizer may be paid only and exclusively upon return to the Operator by the User of the intact admission ticket, in order to allow its fiscal cancellation as required by law. In the absence of such return in intact condition or within the legal deadlines, no refund may be made.
In any case of cancellation and/or postponement of the Event, the Customer may contact the Organizer to assert their rights.
11. Exclusion of the right of withdrawal
With payment, the Purchaser concludes the purchase, accepts and confirms the content relating to the Event.
Before concluding it, the Purchaser undertakes to carefully verify all related data (for example: event date, seat types, etc.). Such data may no longer be modified.
In the case of electronic sales, the right of withdrawal pursuant to Article 59 (exceptions to the right of withdrawal referred to in Articles 52 through 58 of the Consumer Code), paragraph 1, letter n) of the Consumer Code (services relating to leisure activities where the contract provides for a specific date or period of performance) is excluded. In this regard, please also refer to the provisions of Legislative Decree No. 185 of May 22, 1999, Article 7, Paragraph 1, Letter b), and Legislative Decree No. 206 of September 6, 2005, Article 55, Paragraph 1, Letter b), as amended.
Therefore, once the Purchase has been completed and confirmed, the User may not cancel, request a partial or full refund, reschedule dates or times of visit and entry, or change seat types or prices, for any reason whatsoever. Specifically, in compliance with current regulations, please note that the sale of admission tickets for shows and entertainment events involves the simultaneous issuance of such tickets (with the application of tax stamps) via an automated ticketing system certified and authorized by the Italian Revenue Agency upon payment.
Tickets are valid exclusively for the date of the performance and for the seat category and price for which they were issued. Therefore, in the event that the Purchaser is unable to attend the Event—even for any justified and serious reason and/or impediment— no refund, even partial, will be provided by the Organizer, neither for the cost of the event, nor for advance sale fees, nor for agency fees, nor for any other costs incurred by the Purchaser on their own behalf (for example, travel or accommodation expenses).
12. Applicable law and jurisdiction
The Contract is deemed concluded in Italy and is governed by Italian law.
For any dispute, the Court of Milan shall have exclusive jurisdiction, except for consumers.
